The Practice

Clark Whyte practices almost exclusively in banking, property and insurance law and employs in excess of 40 experienced support staff enabling it to conduct a large number of conveyancing transactions, in particular mortgages and discharges, on behalf of a variety of clients each month.

Clark Whyte is currently conducting in excess of 1500 such transactions per month.  Based on the number of documents lodged by the firm at Department of Land Information (DLI), Clark Whyte understands that it is the largest property law firm Western Australia.  The firm ranks only behind the four major banks and Bankwest in relation to documents lodged at DLI.

In acting for a variety of lenders the firm has also developed expertise in all areas of recovery loan funds on behalf of those lenders, in many cases involving loans with a very high loan to value ratio.  Those areas include:

1. Issuing of formal Notices of Default;

2. Instituting court proceedings in the Supreme Court of Western Australia to obtain vacant possession and all chamber summons required to obtain those final orders;

3. the arranging and conducting of mortgagee sales throughout Western Australia (including farming properties);

4. Recovering shortfalls after the sale of mortgaged properties from borrowers and guarantors through the relevant court.

Clark Whyte owns the copyright to a unique computer system installed in January 2003 which was specifically designed to process and track new mortgage files.  The system provides lender clients, loan managers and brokers with internet access to their files to enable them to directly track the progress of individual loans. 

Clark Whyte also acts on behalf of a number of insurers in the workers' compensation and motor vehicle accident areas, providing general claims and risk management advice to both insurers and employers, negotiating the settlement of claims and conducting litigation on behalf of insurers.
